MCA amended Deposits Rules, Charge creation rules and Directors’ KYC forms
In its recent regulatory updation move, MCA has released the Companies (Acceptance of Deposits) Amendment Rules, 2022 introducing submission of declaration by auditor of the company in Form DPT-3 in respect of Annual Return of Deposits. Another amendment is the Companies (Registration of Charges) Second Amendment Rules, 2022 inserting Rule 13 which provides for signing of charge e-forms by Insolvency Resolution Professional or Resolution Professional or Liquidator for companies under resolution or liquidation, as the case may be. Further the companies (Appointment and Qualifications of Director) Third Amendment Rules, 2022 has also been issued updating eForm DIR-3 KYC and DIR-3 KYC WEB by requiring practicing professional to verify applicants’ information more rigorously and asking more information in web KYC form.
